These Terms of Use (“Terms”) constitute a legally binding agreement between you and Excelsior Classes LLC (“Excelsior,” “we,” “us,” or “our”), governing your access to and use of www.excelsiorclasses.com (the “Site”) and any related content, platforms, or online services we provide (collectively, the “Services”).

By using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility & User Responsibilities

The Site is intended for users 13 years of age or older.
Users under 18 must have parental or guardian consent to use the Site or register for classes.
You agree that any information you provide (including during account creation or class registration) is accurate and complete.

2. Intellectual Property Rights

All content on the Site—including course materials, graphics, videos, and logos—is the property of Excelsior Classes or its licensors and is protected under copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive license to access the Site and use its content for personal, non-commercial educational purposes only.
You may not copy, distribute, modify, or exploit any Site content without prior written consent.

3. Acceptable Use

You agree not to:

Use the Site for unlawful or harmful purposes.
Attempt to gain unauthorized access to any systems, data, or accounts.
Upload or transmit viruses, malware, or disruptive code.
Interfere with the operation, security, or integrity of the Site.
Use automated systems (bots, scrapers, etc.) to extract data or content without permission.

Tuition, fees, and payment terms are set forth in our Enrollment Terms & Conditions (linked separately).
By making a purchase through our Site, you agree to follow those enrollment and refund policies.

Our Privacy Policy explains how we collect, use, and safeguard your personal information.
By using the Site, you consent to our handling of your data in accordance with that policy.

6. Third-Party Services

The Site may link to third-party platforms (such as Canvas or Zoom). These providers operate under their own terms and privacy policies.
Excelsior is not responsible for third-party services, outages, or issues beyond our control.

7. Disclaimers

The Site and Services are provided “as is” and “as available.”
While we strive for accuracy and uninterrupted service, we do not guarantee that the Site will be error-free, secure, or continuously available.
Excelsior is not liable for dissatisfaction with course content, teaching style, or outcomes, except as outlined in the Enrollment Terms & Conditions.

8. Limitation of Liability

To the fullest extent permitted by law, Excelsior Classes, its directors, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or Services. Our total liability in any matter shall not exceed the amount you paid to Excelsior (if any) in the six months prior to the claim.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any disputes will first be subject to informal resolution attempts. If unresolved, disputes will be settled through binding arbitration under the rules of the American Arbitration Association (AAA), unless otherwise required by law.
Arbitration will take place in Harris County, Texas, unless both parties agree otherwise.

10. Modifications

Excelsior reserves the right to update or modify these Terms at any time.
Updates will be posted on this page with a new “Last Updated” date. Continued use of the Site constitutes acceptance of the revised Terms.

The Enrollment Terms & Conditions, governing participation in Excelsior Classes’ courses, clubs, and programs, including refund, deposit, and ESA policies

Academic Expectations & Student Conduct

You have read and agree to the Student Code of Conduct, and your student will abide by it. You have read and understand the Academic Honesty Policy and the AI Policy, and agree to comply with all assignment and exam requirements, including use of specified platforms (e.g., Google Docs), revision history, and proctoring procedures. You understand that failure to comply may result in assignment zeros, loss of grading services, or removal from class, and that no refunds will be issued in these circumstances.

Placement, Course Fit, & Readiness

You have consulted with teachers when enrolling a student with learning differences or accommodation needs to ensure the course is an appropriate fit. Your student has completed any required placement assessments (e.g., math classes), and placement has been confirmed with the instructor when applicable.

Worldview & Curriculum Awareness

You understand that Excelsior Classes’ courses are taught within a Christian worldview. You acknowledge that participation does not require affirming a statement of faith. You understand that refunds are not provided for disagreements with course content and that reviewing Required Materials prior to registration is your responsibility.

Technology Responsibility

You acknowledge that providing appropriate technology and reliable internet access for student participation is the parent’s responsibility. You understand that published technology requirements and critical success factors must be met for successful participation.
